Can NRIs buy property in Pondicherry? Rules, limits and paperwork

Yes, with limits. NRIs and persons of Indian origin can buy residential and commercial property in India, but not every kind of land.

What you can and cannot buy

NRIs and persons of Indian origin can buy residential and commercial property. They cannot buy agricultural land, plantations or farmhouses; those can generally be inherited but not purchased. Foreign nationals who are not of Indian origin face stricter rules. Confirm your own category with a lawyer.

How to pay

Payment is normally made through banking channels from an NRE or NRO account or by inward remittance, not in cash. Keep every bank record, because you will need it to prove the source of funds and, later, when selling.

Completing it from abroad

You can complete a purchase by video call and, if needed, a limited power of attorney. The documents still need to be checked properly before you pay anything, which is the part people skip when they are far away. See our buyer service, including the free document check.

Tax and later

Buying is one thing; the tax on rent, and on a future sale, is another. Take advice from a chartered accountant before you buy, and read our guide on NRI rent and TDS.
